Situation is that an STB company is moving from an EMS model to ODM and has already signed up an agreement for product design & production.
However the after sales service (repairs, spare parts, warranty services, etc) was omitted and they now have to negotiate an SLA with the ODM for these.
So, coming from behind in terms of negotiation power, and the ODM holds the strength here.
There are some similarities with portions of a standard ODM service agreement with the medical design service agreement below.
